The Senate Judiciary Committee approved the Patent Act of 2015 (Protecting American Talent and Entrepreneurship Act) as amended by the Manager’s Amendment as well as additions from Senators Feinstein and Cornyn.  The vote was 16-4 with only Senators Cruz, Vitter, Durbin, and Coons voting Nay. Yeas include Senators Grassley, Hatch, Sessions, Graham, Cornyn, Lee, Flake, Perdue, Tillis, Leahy, Feinstein, Schumer, Whitehouse, Klobuchar, Franken, and Blumenthal.

We can expect a few more amendments before being passed in the Senate.  Notably, there is continued debate over whether to alter the statute to force the PTO to more liberally allow claim amendments during post-grant proceedings.  In addition, Universities are pushing to have their patents excluded from post grant proceedings.

Two weeks ago, I published Part 1 in our copyright and licensing series. Here is Part 2, a guest post by our Editor-in-Chief, Tom Olijhoek.

The first part of the post covers 9 different scenarios that have different copyright and licensing conditions. Each scenario illustrates the most common set of conditions that we see for an author's published work. Each scenario is followed by the two questions from the Copyright and Permissions section of the DOAJ Application form, illustrating how those questions should be answered: does the author hold the copyright without restriction; does the author retain publishing rights without restriction? There is a level of complexity in trying to illustrate this issue because there are 3 main variables that come into play:

  • has the author transferred copyright?
  • has a Creative Commons license being applied to the work and if so, which type?
  • has a separate publishing agreement been signed with the publisher?

The second part is a list of examples from publishers who have open access programs. We will update this list with more examples as we find them, particularly those that have unique characteristics.

The last part is for those readers who want to get into more detail on this subject and is a list of recommended reading on this topic. Let us know if you have more!

The Center for Neuroplasticity and Pain (CNAP)  has adopted an Open Access (OA) policy; it has adopted the Danish National Research Foundation's (DNRF) OA policy which was adopted by DNRF in 2012. 

Council for Independent Research, the Danish Council for Strategic Research, the Danish National Advanced Technology Foundation, and the Council for Technology and Innovation also adopted this policy.

The CMS has created a new e-mail address—noinformationblocking@cms.hhs.gov—for these reports and announced it during the Health Datapalooza conference in Washington Tuesday ... Officials plan to act on the reports e-mailed to them, Slavitt said. But the agency has few tools at its disposal to do so.  In April, HHS' Office of the National Coordinator for Health Information Technology released a report indicating widespread business practices by providers and health information vendors that intentionally prevent the easy flow of electronic health records. Practices include charging exorbitant fees to access medical records and simply preventing one company from accessing lines of codes needed to talk to another system ..."

"Making health data more widely accessible and useful to patients and providers could change communities. That's the message resonating during the first day of the three-day Health Datapalooza conference, held in Washington, this week. Farzad Mostashari, former head of the Office of the National Coordinator for Health Information Technology, said health data must be actionable and providers must be ready to respond to it. A doctor receiving a notification that a patient is in the emergency room should realize that means money and opportunity lost, Mostashari said. An office visit, instead, could bring his practice $700 and save his patient from unnecessarily intensive treatment at the hospital. Too often doctors are stuck in the fee-for-service model and focus on how to see a waiting room full of patients rather than how to provide the best quality care. Eliminating unnecessary hospital visits is key to that mindset shift, Mostashari said ..."

The organisation has long been accused of corruption and has been subject to increasing criticism for its lack of transparency and accountability. On Friday Sepp Blatter won re-election as president for the fourth time, yet many have little faith in his ability to improve Fifa's reputation. With the only challenger in that election, Prince Ali bin al-Hussein of Jordan calling for leadership that "restores confidence in the hundreds of millions of football fans around the world", it struck me that open data could help to achieve this. Open data is data that is made available by organisations, businesses and individuals for anyone to access, use and share. In January 2010 data.gov.uk was launched as the home of UK open government data and now contains over 15,000 datasets published with an open licence. Included in these are key government spending datasets which give citizens, journalists, activists and others the ability to see what is being spent where and on what, making governance more transparent. Transparency is perhaps the fundamental argument we can make for government and other public bodies to release open data. Enabling citizens to freely access data related to the institutions and people that govern them is essential to a well-functioning democratic society. The Government of Canada's commitment to open data stems from a desire to foster creativity, entrepreneurship and innovation in its people, encourage expansion of the digital economy, and, through open government, provide a means to counter social injustice and inequity. Brown's talk was on the importance of open data to all sectors of society, recognizing that 'a life unrecorded is a life unsupported', particularly spotlighting the plight of women and children in developing countries. Efforts to open information to address social inequities include the release of global vital statistics and indicators from such organizations as the World Bank and World Health Organization, and the International Aid Transparency Initiative (IATI), so that data is 'open by default'. The United Nations has raised a call to establish global data standards. The United Nations Economic Commission for Africa's Africa Data Consensus was finalized in March 29, 2015 in Addis Ababa, Ethiopia, enshrining its commitment to open data principles and the data revolution ..."

"After five years in operation the Health and Human Services Department's open data website got a refresh last week. The new HealthData.gov went live in "beta" May 28, reflecting that the HHS site is still very much a work in progress ... Davis said the process to build the new site began with the migration of its existing open data catalog to DKAN, a data platform based on the open source web content management system Drupal.  

DKAN is an open source project complementary to CKAN, or the Comprehensive Knowledge Archive Network. Such platforms facilitate data sharing through a layer of software, policies and guidelines. Several government open data sites utilize CKAN, including Data.gov. Others have determined the Drupal-oriented DKAN platform – which was developed by NuCivic – Socrata or Junar are preferred platforms ..."

A report from the Open Data Institute, an independent group founded by individuals including Sir Tim Berners-Lee, suggests that a wider variety of data than ever before is now being employed by companies all over the UK – though one in two businesses making use of such resources is based in London. Small companies are particularly keen users of this information, the ODI says, with micro enterprises – those with fewer than 10 employees – responsible for 70 per cent of the survey responses that it received during its study. " ... Data is an essential part of research, and it is a no-brainer that scientists should share their data. The default approach is and has been 'share on request': if you're interested in a dataset, you simply e-mail the author of a paper, and ask for the data. However, it turns out that this does not work that well. Wicherts, Borsboom, Kats, & Molenaar (2006)  have shown, for example, that authors are not really enthusiastic about sharing data, something not unique to psychology. This is bad. Sadly, not just for the sake of scientific progress – recently, social science has seen another data-fabrication scandal where a graduate student faked his data for a study published in Science (you would think they had learned their lesson at Science after Stapel, but sadly, no). Making data available with your publication at least makes sure that a) you conducted the study, and b) allows others to (re)use your data, saving work in the end. It is therefore not surprising that there is now an open research movement, calling for full transparency in research, including making all research data public by default. I totally support open research, and I have considered signing the 'Agenda' several times. After a discussion of the ISCON Facebook page I have now decided not to. As a matter of fact, the discussion has convinced me that making all research data publicly available without restriction by default is in fact a bad idea. Before the flame-war starts, let me point out that I am not against sharing data between researchers, or not even against compulsory data sharing (i.e., if an author refuses to share data without good reason, her/his boss will send the data). However, I disagree with unrestricted data publishing, i.e. putting all data online where anyone (i.e., the general public) can access it. I am strongly in favour of a system where data is deposited at an institutional repository and anyone interested in the data may ask for access, if necessary even without consent of the author. Let me illustrate my concerns with the following thought experiment ..."

"Our open access briefing sessions have led to some interesting questions. Here are a selection: If I am publishing with someone from another university who has made their work open access do I still need to put my work in RIS? You do still need to put your work in RIS for it to count to Swansea University's REF submission. Does the university have money to pay article processing charges? ISS has money to pay for RCUK funded research. Other funders may allow you to bid for funds within a grant and it may be worth checking with your college whether any funding is available. Details of RCUK funding are on our APC page and we will add information about any other funding we hear about. When do I need to start uploading my research to RIS? The deadline for the REF is April 2016 – anything published from then on has to be open access to be eligible for the next REF. However, the university policy is for people to start now so that any problems can be ironed out and everyone knows what to do by the time of the official deadline. How do I find out about embargo periods and when do they start from? The embargo periods for most publishers are listed in Sherpa Romeo. HEFCW allow up to a year's embargo for STEM subjects and 2 years for other subjects. The embargo is usually counted from the date an article is first made public, whether this is online or in print. Is there a preferred format for documents? It is best to convert your manuscripts to the widely used PDF format. This avoids your work being inaccessible to those without the correct version of Word. Can I add book chapters to RIS? You can certainly add book chapters to RIS provided your publisher allows this. At the moment there is no central source for information on book publishers so you would have to approach them directly. Book chapters are not included in the open access requirements for the next REF so this is a matter of personal choice."
